Today, we share the story of a 54-year-old mother of a Skilled Worker Leave to Remain holder in the UK from India who came to us after facing a visa refusal. Sponsored by her son, a Skilled Worker Leave to Remain holder in the UK, her application was unjustly denied. Through our expert intervention and use of the Pre-Action Protocol (PAP), we successfully secured a reconsideration of her case by the Home Office. Our client initially applied for a UK visitor visa but was refused on grounds that lacked a clear basis. Despite her eligibility, her application was unfairly rejected. Undeterred, she approached NARA Solicitors for assistance. After a detailed review, we identified procedural errors in the refusal and filed a new visa application on her behalf. Unfortunately, this second application was also refused on arbitrary grounds, leaving her with no immediate right of appeal. Determined to secure justice for our client, our team member Gauri Dabas, led by Sukhvinder Singh Nara, prepared and submitted a Pre-Action Protocol (PAP) letter on 31st December 2024. In their response, the Secretary of State for the Home Department (SSHD) admitted to procedural errors in the decision-making process. As a Result: The Home Office agreed to reconsider the refusal decision. This success underscores the power of PAP in addressing unjust decisions and securing timely remedies for clients.
