In May 2025, one of our clients was detained following an immigration enforcement visit.

Although the client had lawfully entered the UK and built a family life over several years, they were detained and served with removal directions. This led to a separation from the client’s spouse and young child, who remained in the UK while the client was held in detention awaiting removal.

The Home Office opposed release, stating that the client no longer had permission to stay in the UK, had previously overstayed leave, and presented a risk of non-compliance. They argued that alternatives to detention were considered but found to be unsuitable, and that detention was necessary to proceed with removal.

Faced with these circumstances, Nara Solicitors acted quickly. Led by solicitor Samarth Singla, the team submitted a bail application to the First-tier Tribunal, setting out detailed legal arguments on the client’s behalf.

The submission highlighted:

  • The client’s established family life in the UK, including care for a dependent child.

  • Active steps already taken to regularise their immigration status, including a pending fee waiver request.

  • The Home Office’s own Bail Guidance, which discourages detention where individuals are pursuing lawful routes to remain.

  • The serious emotional and psychological impact that detention and family separation were causing.

After hearing the arguments, the Tribunal granted bail, allowing the client to reunite with their family while their immigration case continues.
