Today, Our Founder, Sukhvinder Singh Nara had the opportunity to represent an organisation during their Home Office compliance interview for a sponsor licence application.

The organisation is seeking to sponsor a team member who is also a shareholder and director of the business.

The interview lasted nearly an hour and included several probing questions about the genuineness of the role and whether it had been created purely for visa purposes.

In the first quarter of the interview, the officer asked:

“Has this role been created for the shareholder of the company?”

The Authorising Officer answered confidently: No — and that was correct.

However, just before the interview concluded, the officer asked a slightly different version of the question:

“Has this role been created to facilitate the visa of the shareholder?”

This time, the client answered: Yes, contradicting the earlier response.

As the legal representative, Sukhvinder could not interrupt the questioning, but at the end of the interview, he respectfully sought permission to speak. He pointed out that the client may have misunderstood the second question and requested the officer to kindly rephrase it.

The officer initially responded that they did not believe there was a misunderstanding, but then asked the client directly:

“Did you misunderstand the question?”

The client replied: “Yes, I was nervous and didn’t hear it properly.”

The officer then repeated the question:

“Has this role been created to facilitate the visa of the shareholder?”

This time, the client gave the accurate response:

“No, the role has not been created to facilitate a visa. It is an existing role, and the individual has already been managing the company as a shareholder and director.”
