Pre-Action Protocol and Judicial Review for Revocation

If your sponsor licence is being revoked, time is critical. Revocation means you lose the ability to sponsor any workers, and your existing sponsored employees may have their visas curtailed. Acting quickly is essential to protect both your business and your workforce.

What Is Revocation?

The Home Office can revoke a sponsor licence if it believes the employer has failed to meet its sponsorship duties, provided false information, or poses a threat to immigration control. Revocation is the most serious action the Home Office can take against a sponsor.

There is no right of appeal against revocation. The only legal avenue to challenge the decision is through judicial review.

Pre-Action Protocol (PAP)

Before issuing judicial review proceedings, we send a Pre-Action Protocol letter to the Home Office. This letter sets out the legal grounds on which we believe the revocation decision is unlawful and gives the Home Office an opportunity to reconsider.

In many cases, a well-drafted PAP letter can lead to the decision being withdrawn or reconsidered without the need for court proceedings.

Judicial Review

If the Home Office does not reconsider, we apply for judicial review in the High Court. This involves filing an urgent application, often with a request for interim relief to prevent the revocation from taking effect while the case is heard.
