Skilled Worker Visa Application Success After Pre-Action Protocol

Our client was already in the UK on a Skilled Worker visa, working. She submitted her new Skilled Worker visa application on 17 September 2025 for care support role via the app. Then she waited. And waited.
Weeks turned into months. There was no update from the Home Office. No decision. No communication. Just silence.

When Silence Becomes Unacceptable
By December 2025, our client had been waiting over three months with no progress on her application. This kind of delay is not just inconvenient. It affects every aspect of an applicant’s life.
She approached NARA Solicitors for help. After reviewing her case, we decided that the most effective course of action was to challenge the delay formally through a Pre-Action Protocol (PAP) letter.
Our Approach
A Pre-Action Protocol is a formal step that precedes judicial review proceedings. It puts the Home Office on notice that their delay is unreasonable and that legal action may follow if they do not act promptly.
On 24 December 2025, we submitted a PAP against the Home Office’s delay in processing our client’s application. The PAP requires the Home Office to respond within a set timeframe and gives them the opportunity to resolve the matter before court proceedings begin.
The Outcome
The PAP worked. Shortly after our submission, the Home Office processed our client’s application. Today, she received the successful outcome of her visa.
If your visa application has been pending for an unreasonably long time with no updates, you do not have to simply wait and hope. There are legal options available to you.
A Pre-Action Protocol can be an effective way to prompt the Home Office into action. However, it needs to be drafted correctly and submitted at the right time. Too early, and it may not be taken seriously. Too late, and you may have suffered unnecessary delays.
